1. General provisions

 

1.1. "bystrika.com" hereinafter "Seller", publishes the Public Offer for the sale of the goods presented on the Seller's official website https://bystrika.com.


1.2. Carefully read the text of the public offer, and if you do not agree with any clause of the offer, you are invited to refuse to buy Goods or use the Services provided by the Seller.


1.3. In this offer, unless the context otherwise requires, the following terms have the following meanings:
"Offer" is a public offer of the Seller addressed to any individual (citizen) to conclude a sales contract with him (hereinafter referred to as the "Agreement") on the existing terms contained in the Agreement, including all its annexes.
"Buyer" is an individual who has concluded an Agreement with the Seller on the terms contained in the Agreement.
"Acceptance" is a full and unconditional acceptance by the Buyer of the terms of the Agreement.
"Goods" is a list of assortment items presented on the official website.
"Order" - separate items from the assortment list of Goods specified by the Buyer when making an application on the website.

 
2. Subject of the contract

 

2.1. The Seller sells the Goods in accordance with the current price list published on the Seller's website "https://bystrika.com", and the Buyer pays and accepts the Goods in accordance with the terms of this Agreement.


2.2. This Agreement and its annexes are official documents of the Seller and an integral part of the offer.

 
3. Placing An Order

 

3.1. Goods are ordered by the Buyer through the website https://bystrika.com.


3.2. When ordering Goods, the Buyer undertakes to provide the necessary registration information about himself: surname, first name, e-mail address; contact phone number, and a physical address in case of ordering a physical product.


3.3. The buyer has the right to edit the registration information about himself. The Seller does not change or edit the registration information about the Buyer without the consent of the latter. The Seller undertakes not to disclose the Buyer's data specified when placing the Order on the website https://bystrika.com to persons not related to the fulfilment of the Order. By approving the Order of the selected Goods, the Buyer provides the Seller with the necessary information in accordance with the procedure specified in p. 3.2. of this Agreement.


3.4. The Seller is not responsible for the content and reliability of the information provided by the Buyer when placing the Order.


3.5. The Buyer is responsible for the accuracy of the information provided when placing an Order.


3.6. Payment by the Buyer of the Order independently placed on the website means the Buyer's consent to the terms of this Agreement. The day of payment for the Order is the date of conclusion of the Sales Agreement between the Seller and the Buyer.


3.7. If the Buyer has any questions regarding the properties and characteristics of the Goods, he should consult the Seller before placing an Order.

 
4. Terms of order fulfilment

 

4.1. Digital Goods are delivered to the Buyer immediately after placing and paying for the Order. Delivery of Digital Goods may be delayed for up to 24 hours from the date of payment.

The delivery time of the physical Goods includes: the time for the production of the Goods (about 3 days) and the time of delivery of the Goods, which directly depends on the company delivering the Goods (on average 2-3 weeks).


4.2. If the Buyer provides false information with his contact details, the Seller shall not be liable for improper fulfilment of the Order.

 
5. Payment For The Order

 

5.1. Payment for the Order is made by transferring funds by the Buyer to the Seller through the payment form of the "PAYPAL" service.
Confirmation of payment for the executed Order is an information letter that comes to the Buyer by e-mail after payment of the Order.

 

5.2. Prices for any items of the Digital Goods specified on the website https://bystrika.com may be changed unilaterally by the Seller without notice to the Buyer. In the event of a change in the price of the ordered items of the Goods, the Seller undertakes to inform the Buyer of such change as soon as possible. The Buyer has the right to confirm or cancel the Order.

 
6. Delivery of goods.

 

6.1 Digital Goods are delivered to the Buyer by sending links to the specified e-mail address after placing and paying for the Order.

The physical Goods are delivered by specialized delivery companies to the address specified when placing the Order.

 
7. Return Order

 

7.1. In case of Digital Goods: refunds are possible only in the period from the moment of payment until the provision of access to the Digital Goods.

 

In case of Physical Goods:
1) If the Physical Goods arrived in an improper physical condition, the Buyer has the right to send the received Physical Goods to the Seller at the Seller's expense and receive a full refund or keep the Physical Goods and receive a partial refund, depending on the degree of non-compliance of the Physical Goods with the declared characteristics.

 

2) If the Physical Goods correspond to the declared characteristics, but the Buyer refuses the delivered Physical Goods for personal reasons, the Buyer has the right to send the Physical Goods to the Seller at his own expense within 14 days from the moment of receipt of the Physical Goods and receive a full refund.

8. Copyrights

 

8.1. All text information and graphic images posted on the website https://bystrika.com, as well as in the content of Digital Goods, are the property of the Seller.

 

All copyrights belong exclusively to the Seller even after the purchase of Physical and Digital Goods by the Buyer.

 

The Buyer has the right to use the Physical and Digital Goods purchased from the Seller solely for personal purposes.

 

The Buyer's use of the Digital and Physical Goods, purchased from the Seller, for commercial purposes is illegal and entails legal liability in accordance with the international Copyright law.

 
9. Rights, obligations and responsibilities

 

9.1. The Seller is not responsible for improper use of goods by the Buyer ordered on the website.


9.2. The Seller undertakes: to prevent attempts of unauthorised access to information and/or its transfer to persons not directly related to the execution of Orders; to detect and suppress such facts in a timely manner.


9.3. The Buyer has the right to send all claims regarding improper execution of the order via the form below.

 

9.4. The Seller reserves the right to select Buyers, as well as to add some Buyers to the "Black List" and terminate all interaction with them for failure to comply with basic standards of decency.
